Terms of service.
Effective July 5, 2026
These Terms of Service (“Terms”) govern your use of the Emari Roast Café (“Emari,” “we,” “us”) website at emariroastcafe.com and the Emari Café mobile app (together, the “Services”). By creating an account, placing an order, booking our private room, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services. Your use of the Services is also subject to our Privacy Policy.
Who can use the Services
You must be at least 13 years old to use the Services and old enough to form a binding contract to make a purchase. If you use the Services on behalf of another person or a business, you represent that you are authorized to accept these Terms for them.
Your account
You can browse and place pickup orders on the website as a guest, but some features — such as order history, rewards, gift cards, and private room bookings — require an account. You may create an account with an email address and password, or by using Sign in with Apple or Google sign-in. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Let us know right away if you believe your account has been used without your permission. You can delete your account at any time from the mobile app or by emailing us, as described in our Privacy Policy.
Orders and pickup
Orders placed through the Services are for pickup only at our café at 987 Wilshire Dr, Ste C, Troy, MI 48084. We do not offer delivery through the Services. Placing an order is an offer to purchase; an order is confirmed once we accept it and charge your payment method. We prepare orders during our normal business hours, and pickup times are estimates rather than guarantees.
We may refuse or cancel any order — including for items that are out of stock, pricing or description errors, suspected fraud, or problems with your payment. If we cancel an order you have already paid for, we will refund the amount charged.
Prices and availability
Menu items, prices, availability, and business hours are set by the café and may change at any time without notice. We work to keep the Services accurate, but occasionally an item may be listed incorrectly or be unavailable when you order. Applicable taxes are added at checkout. The price that applies to your order is the total shown to you at the time you complete checkout.
Payments
Payments are processed by Square, including Apple Pay where available. Your card details are handled directly by Square and never touch our servers. By completing checkout, you authorize a charge for the total shown at the time of your order. If a charge cannot be completed, your order will not be confirmed. Your use of Square-processed payments is also subject to Square’s own terms.
Refunds and cancellations
Because food and drink are prepared to order, order refund and cancellation requests are handled on a case-by-case basis — if something is wrong with your order, please contact us within 24 hours and we will make it right. Private room bookings may be cancelled or changed subject to the booking terms shown at the time you book. Refunds, when issued, are returned to the original payment method through Square.
Rewards program
If you join our rewards program, you earn and redeem points through Square Loyalty using the phone number you enroll with. Points and rewards have no cash value, cannot be transferred or sold, and may expire or be adjusted in accordance with the program rules. We may change or end the rewards program, or correct point balances affected by error or misuse, at any time.
Gift cards
Gift cards are issued and managed through Square. They can be redeemed toward purchases at the café and hold no implied warranties. Except where required by law, gift cards are not redeemable for cash and are not reloadable through the Services unless stated. We are not responsible for gift cards that are lost, stolen, or used without your permission. If you send a gift card to someone, you are responsible for entering the correct recipient details.
Private room bookings
You can reserve our private room in one-hour slots during café hours, subject to availability. Payment for a booking is collected at the time you reserve, through Square. Please arrive and vacate within your reserved time so the room is ready for the next guest. We may cancel a booking if the café is closed for an emergency or unforeseen circumstance; in that case we will refund the amount you paid. Bookings are for lawful use of the space and remain subject to café policies and staff direction.
Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent, or abusive purpose
- Place orders or bookings you do not intend to honor, or use another person’s payment method without authorization
- Interfere with or disrupt the Services, or attempt to access accounts, systems, or data you are not authorized to access
- Copy, scrape, or resell any part of the Services, or submit false or misleading information through our forms
Intellectual property
The Emari name, logo, menu descriptions, photographs, page designs, and other content on the Services are owned by Emari or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. You may not use our name or branding, or reproduce our content, without our written permission.
Third-party services
The Services rely on third parties — including Square for payments, loyalty, and gift cards; Apple and Google for sign-in and Apple Pay; and providers for email and app notifications. Your use of those features may be subject to the third party’s own terms, and we are not responsible for their services. If you downloaded the app from the Apple App Store or Google Play, your use of the app is also subject to that store’s terms.
Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. If you have a food allergy or dietary restriction, please tell our staff before ordering — we cannot guarantee any item is free of a given allergen.
Limitation of liability
To the fullest extent permitted by law, Emari and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the order or booking that gave rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the effective date above. Changes apply going forward, and your continued use of the Services after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute relating to the Services will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction.
